The Iranian legal system has already completed four stages of legislation in the field of compulsory insurance of civil liability of owners of motor vehicles against third parties. These acts were enacted in the years 1952, 1968, 2008 and 2016, respectively. The new act has brought about innovations and developments regarding the protection of rights for both the damaged party and the insured, including the lack of need to obtain an addendum by the insured, the expanding of the concept of incident, the expanding of the concept of a third party and the separation between the policyholder and the driver of the vehicle. Another innovation is to increase the insurer and the bodily injury indemnity fund’s duties and anticipating the guarantee of civil and criminal acts in order to prevent their abuse. In this article, we study the strengths and weaknesses of the act. In some respects, this act is a reinstatement to act of 1952, which pays more attention to insurance indemnity than civil liability insurance.
